Terms of Service

1. The service

Birthday Genie is a software service operated by Automuss Technologies Ltd, a company registered in England and Wales. The service allows users to manage birthday reminders, generate personalised messages using artificial intelligence, and deliver those messages via WhatsApp and email.

2. Eligibility

You must be at least 16 years of age to use Birthday Genie. By using the service, you confirm that you meet this requirement. If you are using the service on behalf of an organisation, you confirm that you have the authority to bind that organisation to these terms.

3. Your account

You are responsible for maintaining the security of your account and all activity that occurs under it. Notify us immediately at support@automusstech.com if you suspect unauthorised access. We are not liable for losses arising from compromised credentials.

4. Acceptable use

You agree not to:

• Use the service to send unsolicited, harassing, or abusive messages
• Attempt to access systems or data you are not authorised to access
• Reverse-engineer, decompile, or extract our source code
• Resell or sublicense the service without written permission
• Use the service for any unlawful purpose

5. Subscriptions and payments

Paid plans (Pro and Pay-as-you-go) are billed in GBP. Subscriptions renew automatically unless cancelled before the renewal date. We use Stripe to process payments securely. We do not store your card details.

You may cancel your subscription at any time from your account settings. Your access continues until the end of the current billing period. We do not offer refunds for partial periods except where required by law.

We offer a 14-day money-back guarantee on all paid plans from the date of first payment. Contact us at support@automusstech.com to request a refund.

6. AI-generated content

Birthday Genie uses OpenAI's GPT-4o-mini to generate birthday messages. You are responsible for reviewing messages before they are sent. We are not liable for the content of AI-generated messages. You retain ownership of any messages sent through the service.

7. WhatsApp delivery

WhatsApp delivery is provided via Twilio and is subject to WhatsApp's Business Platform policies. Delivery is not guaranteed in all regions or for all phone numbers. We are not liable for failed or delayed WhatsApp deliveries caused by third-party service outages.

8. Limitation of liability

To the maximum extent permitted by law, Automuss Technologies Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account if you violate these terms. You may delete your account at any time from your settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Changes to these terms

We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after changes constitutes acceptance of the new terms.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
